Terms of Service

These Terms of Service (“Terms”) govern your use of NovaHost.ai (“Service”), a managed AI platform hosting service operated by NovaHost (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.
1. Service Description
NovaHost provides fully managed cloud hosting for Dify, an open-source AI application platform. The Service includes:
- Provisioning and management of private Dify AI instances
- Server infrastructure, security patches, and automatic updates
- SSL certificates and optional custom domain configuration
- Daily automated backups with 30-day retention
- Technical support based on your subscription plan
2. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.
3. Subscription & Billing
- Subscriptions are billed monthly or annually based on your selected plan
- All plans include a 14-day free trial. No credit card is required to start
- Payments are processed securely by Stripe. We do not store payment card details
- You may upgrade, downgrade, or cancel your plan at any time from your dashboard
- Downgrades take effect at the end of the current billing period
- Refunds are handled on a case-by-case basis within 30 days of payment
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Generate or distribute illegal, harmful, or malicious content
- Attempt to gain unauthorized access to other users' instances
- Resell the Service without our written authorization
- Overload or disrupt the Service infrastructure (e.g., DDoS attacks)
- Use the platform for cryptocurrency mining or unrelated compute workloads
5. Data Ownership
You retain full ownership of all data you upload, create, or generate on your AI instance — including documents, chatbot configurations, knowledge bases, and workflows. NovaHost does not claim any ownership or license to your data.
6. Service Level Agreement (SLA)
- Lite plan: No uptime guarantee (best-effort)
- Pro plan: 99.9% monthly uptime guarantee
- Max plan: 99.99% monthly uptime guarantee
If we fail to meet the SLA for your plan in any calendar month, you are eligible for service credits as described in our SLA documentation.
7. Termination
You may cancel your subscription at any time. Upon cancellation, your instance remains active until the end of the billing period. After that:
- You have 14 days to export your data
- Your instance is stopped after the billing period ends
- Your data is permanently deleted 30 days after cancellation
We may suspend or terminate your account for violation of these Terms, with notice where reasonable.
8. Limitation of Liability
To the maximum extent permitted by law, NovaHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use after changes constitutes acceptance.
10. Governing Law
These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in the courts of the jurisdiction where NovaHost is incorporated.
